1. Acceptance of Terms
By accessing or using the Superpets application ("App") or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
Superpets is an AI-powered application that transforms pet photos into superhero-themed portraits. The Service is provided by Colossus Software LLC ("we", "us", "our").
3. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.
5. Credits and Purchases
- Credits are required to generate AI portraits. New accounts receive 5 free credits.
- Additional credits can be purchased through in-app purchases (iOS App Store or Google Play Store) or on the web.
- Credits are non-transferable and have no cash value.
- Credits do not expire.
- If a generation fails, credits are automatically refunded to your account.
6. Refund Policy
Refunds for in-app purchases are handled by the respective platform (Apple or Google). Visit reportaproblem.apple.com for iOS or your Google Play order history for Android. For web purchases, contact support@superpets.fun.
7. User Content
- You retain ownership of photos you upload ("User Content").
- By uploading photos, you grant us a limited, non-exclusive license to process them solely for the purpose of generating AI portraits.
- Original pet photos are not stored permanently on our servers.
- Generated images are stored securely so you can access them in your history.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload content that is harmful, offensive, or infringes on the rights of others.
- Attempt to reverse-engineer, decompile, or hack the Service.
- Use automated tools to access or scrape the Service.
- Resell or redistribute generated content for commercial purposes without permission.
9. Intellectual Property
The Service, including its design, features, and AI models, is owned by Colossus Software LLC. You may use generated portraits for personal, non-commercial purposes. The superhero characters and styles are inspired by popular culture and are used for creative, transformative purposes.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated results will meet your expectations.
11. Limitation of Liability
To the maximum extent permitted by law, Colossus Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.
12. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may delete your account by contacting support@superpets.fun.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes through the App or by email.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
